Council & Compliance Requirements
What you'll typically need to legally operate a coffee stall at a market in NSW. Requirements vary by council โ always confirm with your local authority.
๐๏ธ Food Business Notification & Registration
Food Business Notification (NSW)
Register your food business with your local council before trading. One-time registration โ renew annually. Apply via your council's website or NSW Food Authority.
Food Safety Supervisor Certificate
At least one person on-site must hold a current Food Safety Supervisor (FSS) certificate. Obtain via an approved RTO โ valid for 5 years.
Temporary Food Stall Permit
Many councils require a permit for temporary/mobile food operations. Apply to the council where the market is held โ not your home council.
๐ Hand Washing & Wash Station
Dedicated Hand Wash Basin
Separate from equipment washing. Must have running water, liquid soap, and single-use paper towels. A portable hand wash station with fresh and waste water tanks is acceptable.
Equipment / Utensil Washing (3-Step)
Wash โ Rinse โ Sanitise using food-grade sanitiser. A portable 3-sink system or access to market washing facilities is required.
Waste Water Disposal
Waste water must go to a sanitary sewer โ not on the ground or stormwater drain. Confirm disposal point with the market organiser.
Portable Water Tanks
Minimum 20 L fresh water tank plus sealed waste water tank of equal or greater capacity. Clearly labelled.
๐ฅ Safety Equipment & Insurance
Public Liability Insurance
Minimum $10โ20 million cover. Most markets require a Certificate of Currency (COC) before you can trade. Must cover the event date.
Fire Extinguisher
ABE dry powder or COโ extinguisher accessible at all times. Must be tagged and inspected annually. Class B recommended if using gas.
Gas Safety Certificate
All gas equipment must be installed and certified by a licensed gasfitter. Carry the compliance certificate on-site. Cylinders must be secured and ventilated.
Electrical Test Tags & RCD
All portable electrical equipment must be tested and tagged by a licensed electrician. A Residual Current Device (RCD) is required when using a generator or mains power.
First Aid Kit
A basic workplace first aid kit on-site. May be required at larger events.
๐ฅ Food & Milk Handling
Refrigeration for Milk
Milk must be kept below 5ยฐC at all times. Use a powered fridge or coolbox with thermometer. Log temperatures if inspected.
Food-Grade Surfaces & Equipment
All surfaces contacting food or beverages must be smooth, non-absorbent, and cleanable. Stainless steel or approved plastics only.
Allergen Information
Be prepared to answer questions about dairy milk, alternative milks, and any food products sold.

Overhead Cover / Marquee
A marquee or fixed overhead cover to protect food from contamination (birds, rain, sun on milk). Most councils require this for food stalls.
Covered Waste Bins
General waste and recyclables in covered bins. Remove all waste at the end of the day.
Signage with Business Name & Prices
Clear signage is good practice and may be required by some market organisers.
